How Long Can I Keep Oysters in the Fridge? The Answer at Each Stage

Live oysters in the shell keep five to seven days in a refrigerator held at 40°F or below, and shucked oysters keep three to five days in their liquor or until the printed sell-by date, whichever comes first. The clock starts on the harvest date stamped on the tag, not on the day you carried the bag home. Washington State's Department of Health allows up to seven days for oysters that close their shells completely and up to three days once they are shucked. Clemson Cooperative Extension allows seven to ten days live and five to seven shucked. The FDA tells consumers to use seafood within two days of purchase. Subtract the days already spent between harvest and your kitchen, then use the shorter number.

The clock starts at the harvest date on the tag

Every sack of live oysters in US commerce carries a durable, waterproof tag, and that tag is a dated document. Washington's harvester requirements sheet (DOH 332-093) lists what it must carry: the harvester's name and address, the harvester's certificate number, the date of harvest, the harvest location including the state abbreviation and a growing-area identifier, the type and quantity of shellfish, and a capital-letter statement reading THIS TAG IS REQUIRED TO BE ATTACHED UNTIL CONTAINER IS EMPTY OR IS RETAGGED AND THEREAFTER KEPT ON FILE, IN CHRONOLOGICAL ORDER, FOR 90 DAYS.

Under FDA Food Code 3-203.12, the tag stays on the container until it is empty. The business then writes the last date of use on it and files it. Oregon Health Authority's Food Code fact sheet explains the ninety days plainly: hepatitis A has an incubation period much longer than other shellfish-borne diseases, so the paperwork has to outlive the illness.

The same fact sheet has the sentence that makes the harvest date matter to you. "Raw shellfish are not required to be date marked." Nobody is obliged to hand you a use-by date on a live oyster. The harvest date is the only date the system generates, and it is sitting in the bag.

I read ingredient lists for what is structural and what is decoration, because a kitchen that does not shop must know which parts of a recipe survive substitution. The harvest date and the temperature history are structural. The variety name on the chalkboard is decoration. Until the spring of 2023 I told volunteers to count seven days from the day a delivery landed at our door. Then we started photographing tags. Across that season the donated shellstock arrived four to six days past harvest, twice at nine. Counting from delivery day was inventing days we had already spent.

Stage one: from the water to the first refrigeration

The regulated clock starts long before you touch it. Virginia's Warm Water Harvest Regulations define harvest time as beginning once the first harvested shellstock is no longer submerged and running until that harvest is placed in refrigeration. Those hours are counted and capped.

From May 1 through October 31, a Virginia oyster harvester has to satisfy one of four options. Land and refrigerate the catch by 11:00 a.m. in May, by 10:00 a.m. from June 1 through August 31, and by noon from September 1 through October 31. Or cap harvest-and-transport-to-refrigeration time at five hours in May, September and October, three hours in June, and two hours in July and August, documented by an approved GPS tracker. Or work under an ice permit. Or tag the catch green for shucking or post-harvest processing only and refrigerate by noon that day.

The numbers continue at the dealer. Virginia requires certified dealers handling oysters to cool them to 55°F or below within five hours of being placed into refrigeration, May 1 to October 31, whether on a boat, in a truck or at a facility. Land deliveries in that window must be mechanically refrigerated to 45°F or less, or iced. Washington runs a parallel structure on a different calendar: oyster harvest follows the state's Vibrio parahaemolyticus control plan from May 1 through September 30, and NSSP Chapter 8.03 the rest of the year.

Above all of it sits the National Shellfish Sanitation Program's own limit: once shellstock is under temperature control, it may not sit without ice or mechanical refrigeration for more than two hours at points of processing or transfer such as loading docks. Two hours is the whole allowance for a pallet on a dock in July.

I cannot vouch for that chain from personal experience. I have never been on a harvest boat or read a dealer's cooler log. What I can vouch for is what a tag says when a box reaches our door and what happens afterward, because I have written down both for four years.

Stage two: the store, the restaurant and the 41°F rule

Molluscan shellfish is a time and temperature control for safety food under the FDA Food Code, so section 3-501.16 applies. Oregon's fact sheet puts it without qualification: all shellfish products must be stored below 41°F (5°C), above and away from other raw animal foods.

There is a deliberate gap between that number and the one the truck operates under. Live shellstock may be received at an ambient 45°F with an internal meat temperature no higher than 50°F, then cooled to 41°F within four hours. Shucked shellfish is received at 45°F or lower and cooled the same way. The 50°F figure is a hard edge in NSSP corrective-action guidance: if a cooler drifts above 45°F, meats are checked, and product at or below 50°F is moved or iced while anything above 50°F is destroyed.

Shellstock may leave its original container only immediately before sale, and when displayed it goes on drained ice, since undrained meltwater pools and leaches. Oregon's sheet also tells operators to check shellstock daily and pull anything dead or cracked.

Your refrigerator is the one link in this chain with no thermometer log and no inspector. FDA sets the consumer target at 40°F or below.

Stage three: your refrigerator, and the days it can buy

The published US figures disagree, and the disagreement is worth seeing whole.

That spread runs from one day to ten for the same animal, which looks like carelessness until you notice the sources answer different questions. FDA answers how long after purchase. The extension figure answers how long a healthy oyster can stay alive in good cold storage. The state chart draws a conservative outer bound. One variable reconciles them: the days already gone.

The strongest argument against leading with the harvest date is that handling beats the calendar, and it is a good one. An oyster harvested nine days ago, iced within two hours and held at 38°F the whole way, is in better shape than one harvested three days ago that spent an afternoon in a warm van. I have received both. Handling is invisible to you and the date is not. It is the one variable the system must print and hand over, and when it misleads it misleads toward caution.

My own worst mistake with shellfish was about storage rather than timing. The first winter I ran this kitchen, in 2021, a restaurant closing for renovation donated roughly sixty oysters. I put them in a lidded tub with a few inches of cold tap water, thinking that keeping them wet kept them alive. Every one was dead by morning. Fresh water kills oysters outright, and a sealed container suffocates whatever the fresh water has not. Clemson's guidance says so; I had not read it. Sixty oysters, one donation nobody could replace, nobody fed.

Storing them correctly takes about a minute.

  1. Keep the tag and write the harvest date where you will see it.
  2. Put them in an open bowl or self-draining pan, cup side down, so they hold their liquor.
  3. Cover them with a damp paper towel. Never seal the container and never submerge them.
  4. Store them on the coldest shelf, away from the door, at 40°F or below.
  5. Check daily and remove any that gape open and will not close when tapped, along with any cracked shells.

A licensed kitchen cannot follow step three as written. Oregon's fact sheet prohibits cloth towels over shellfish and points operators to FDA's recommendation of ice in a self-draining pan. At home a damp paper towel does the same work: humid air, free drainage, no standing water.

Live shellstock versus shucked oysters: different labels, different evidence

These are two products with two clocks, and the paperwork tells you so.

Shellstock carries a harvest date. Shucked oysters carry a container label governed by Food Code 3-202.17: the name, address and certification number of the shucker, packer or repacker, plus a "sell by" or "best if used by" date on packages under one-half gallon, or the date shucked on packages of one-half gallon and larger. So the small retail cup gives you a date somebody else calculated, while the half-gallon tub may give you only the shuck date and put you back to counting days yourself.

The biology differs more than the labels do. Shellstock is a live animal that respires, so its storage rules read like animal husbandry: open container, humid cover, free-draining, never sealed. A shucked oyster is dead tissue in its own liquor, and its rules invert to a tightly closed container so the liquor does not evaporate.

The evidence available to you differs most of all. With shellstock you can run a test. Tap the shell; a live oyster closes. FDA's guidance is to reject clams, oysters and mussels that do not close when tapped, and to throw away any whose shells are cracked or broken. With shucked oysters there is no test. You have a printed date, a certification number and the smell of the liquor.

The failure modes follow. Shellstock fails in two stages, dying first and spoiling second, which gives you a visible warning between them. Shucked meat has only the second stage. If the oysters will sit in your refrigerator longer than two days, buy them in the shell.

How to tell oysters have gone bad, and the one thing the test cannot tell you

A gaping shell that will not close when tapped means the oyster is dead, and both FDA and Washington State's Department of Health say to throw it out. Cracked or broken shells go in the bin too. Beyond those two rules I go on the liquor: a live oyster shucks wet, clear liquid around plump meat, while a failing one shucks dry and smells sour rather than briny. That last part is my judgment rather than agency guidance.

Here is the limit of every one of those checks. CDC states it directly: "An oyster that contains harmful germs doesn't look, smell, or even taste different from any other oyster." Hot sauce and lemon juice do not kill Vibrio, and neither does drinking alcohol with them. CDC estimates 80,000 vibriosis cases a year in the United States, 52,000 of them from contaminated food, and with Vibrio vulnificus about one in five infected people die, sometimes within a day or two.

So the tap test is a spoilage test rather than a safety test. It tells you whether the animal is alive. It tells you nothing about what is inside it. Cooking is the only kill step, and CDC gives the numbers: shucked oysters boiled at least 3 minutes, fried in oil at 375°F for at least 3 minutes, broiled 3 inches from the heat for 3 minutes, or baked at 450°F for 10 minutes. In the shell, boil until the shells open and continue boiling another 3 to 5 minutes, or add them to an already-steaming steamer and cook another 4 to 9 minutes.

We cook every oyster we are given, because people with liver disease and compromised immunity eat at our tables and CDC is explicit that higher-risk people should not eat raw oysters at all.

What the "R months" rule gets wrong

The old rule says eat oysters only in months containing the letter R, which excludes May through August. It was built on a real signal and drawn in the wrong place.

CDC reports that Vibrio bacteria "are found in higher numbers in May through October, when water temperatures are warmer." September and October both contain an R. Regulators draw the season the way the bacteria do: Virginia's Warm Water Harvest Regulations run May 1 through October 31, and Washington's Vibrio parahaemolyticus control plan for oysters runs May 1 through September 30. Neither ends in August. CDC also notes that you can get sick from eating oysters during any month of the year.

What replaced the calendar is the tag. The harvest date and location tell you which state's control plan the oyster was landed under and in which month of that plan, which is what the R-month rule was clumsily trying to ask. You can read it before you buy.
